    We begin by confirming eligibility. The U.S. citizen or permanent resident sponsor must show proof of status, and the qualifying family relationship must be established. If the case is viable, we outline the best path forward.

  2. 02

    Petition Filing (Form I-130)

    (6-18 months, varies by category)

    Your attorney prepares and files the I-130 petition with USCIS, including evidence of the family relationship and the sponsor’s status. For immediate relatives of U.S. citizens, this moves quickly, while family preference categories can take longer to process.

    Visa Availability & Waiting

    (No wait for immediate relatives; several years or more for family preference categories)

    For immediate relatives of U.S. citizens, visa numbers are always available and the case can proceed without delay. For family preference categories, you must wait until the priority date becomes current according to the Visa Bulletin before moving forward.

  4. 04

    Adjustment of Status or Consular Processing

    (12-18 months)

    If the family member is in the U.S. with lawful status and a visa is available, they file the I-485 adjustment of status along with applications for work and travel permits. If the family member is abroad, the case transfers to the National Visa Center and then to a U.S. consulate for immigrant visa processing.

    Interview & Decision

    The applicant attends an interview either with USCIS in the U.S. or at a U.S. consulate abroad. The officer reviews eligibility, the family relationship, and supporting documents. If approved, the applicant receives lawful permanent residence.
